Kentucky Clerk Appealing Judge’s Decision
A headstrong Rowan County, Ken. clerk doesn’t mind staying in jail for her cause and beliefs. However, she’d rather be a free woman.
Kim Davis’ attorneys are appealing a judge’s decision last week to put the woman behind bars after she refused to issue same-sex couples marriage licenses. In a three-page motion, the attorneys don’t know why she should be released but replaces the earlier appeal of the order.
Davis is an apostolic Christian who believes gay marriage is a sin, and that she’d be committing sin by issuing marriage licenses to those couples, as their issued under her authority. She attempted to get the state’s lawmakers to change the law, legally challenging it and ensuring it went all the way to the federal appeals court.
The U.S. Supreme Court legalized same-sex marriage around the nation in June. A day later, Davis quit issuing licenses altogether. Two straight and two gay couples sued Davis. And, U.S. District Judge David Bunning told Davis she must issue them. The Supreme Court upheld Bunning’s order.
However, she didn’t comply because she couldn’t betray God or her conscience.
Therefore, on Thursday, the judge said Davis was disobeying his order and found in contempt of court. He sent her to jail. He then told Davis’ deputy clerks to start issuing them on Friday while Davis was in jail.
One of her attorneys Mat Staver said the licenses are not worth anything because they don’t have her authorization. However, Rowan County Attorney Cecil Watkins said they are indeed valid. Bunning said he wasn’t sure if they were but wanted them issued in spite the fact.
Bunning has said Davis will stay one week in jail. She could remain there if she doesn’t obey his order and start issuing the licenses. Bunning said he’d release Davis if she wouldn’t get in the way of her deputies issuing the licenses. She refused.
Staver said Davis won’t resign and she won’t give up her conscience. Instead, she’ll do as Martin Luther King Jr. did, which is pay for her decision.
